Terms and conditions

The website www.lunariacandles.it is owned by Lunaria di Alice Pasi with registered office in Via Giorgio La Pira, 2 – 50038 Scarperia e San Piero (FI), and is aimed at the sale of home decor products online.

1. Definitions

1.1. In order to allow correct and complete understanding and acceptance of these terms and conditions, the words used will have the meaning indicated below:

Owner: Lunaria of Alice Pasi, Via Giorgio La Pira, 2 – 50038 Scarperia e San Piero (FI), VAT number 07063740489, email address lunariacandles@gmail.com;

Site: the Lunaria candles website;

Products: the products and/or services offered through the Site;

User: the person who accesses the Site, without distinction of legal nature and purpose pursued, interested in the Products offered through the Site;

Conditions: this contract which governs the relationships between the Owner and the Users and the sale or supply of the Products offered through the Site.

2. Acceptance of the terms and all general conditions of sale

2.1. By placing an order according to the methods provided on the Site, the User declares to have taken note of all the information provided during the purchase procedure and to fully accept the general conditions of sale and payment expressed below.

2.2. The sales contract stipulated between the User and the Owner is governed by these general conditions of sale, together with the conditions relating to the completion of the order and the methods of delivery and payment of the goods.

2.3. The Owner reserves the right to modify these Conditions at any time. Changes and updates will be binding as soon as they are published on the Site. The User is therefore invited to view the Conditions each time they access the Site.

3. Order and purchase on the Site

3.1. The products on the Site can be purchased by the User only on the condition that he or she is at least eighteen years of age.

3.2. In order to purchase the products, the User can log in as a guest or can choose to register on the Site. If the User chooses to register on the Site, they are responsible for keeping their access credentials.

3.4. The Owner undertakes to describe and present the Products sold on the Site in the best possible way through descriptions, technical specifications and photographs. The photographs of the Products on the Site do not constitute a contractual element, as they are only representative.

3.5. The User expressly gives the Owner the right to accept the order placed even only partially (for example in the event that all the Products ordered are not available). In this case the contract will be considered finalized in relation to the Products actually sold.

3.6. The Owner confirms acceptance of the order by sending an email to the email address that the User will communicate during the purchase phase;

3.7. The User will be required to check that the data in the order confirmation email is correct and to immediately report any errors or deficiencies to the Owner;

3.8. The Owner reserves the right at his sole discretion not to accept the order.

4. Prices and payments

4.1. The Products, prices and conditions of sale of the Products must always be considered subject to express confirmation via email, or by viewing the order confirmation page by the Owner, after checking the availability of the chosen Product.

4.2. The Owner reserves the right to modify, at any time, the price of the Products and any shipping costs thereof. It is understood that any modifications will in no case prejudice the contracts already concluded before the modification.

4.3. The sales prices of the Products are expressed in Euros, including VAT, if due. Prices do not include shipping costs. Shipping costs and any other taxes and/or costs payable by the User will be clearly indicated in the "Shipping" section of the Site.

4.4. The User undertakes to pay the price of the Product purchased in the times and ways indicated on the Site.

4.5. Payment for the Products can be made using the methods indicated on the Site at the time of purchase.

4.6. The Site uses third-party tools for payment processing and does not come into contact in any way with the payment data provided (credit card number, password, etc.).

If these third-party tools deny payment authorization, the Owner will not be able to supply the Products and will not be responsible for any delay or failure to deliver.

5. Subscription service

5.1. With the subscription service, the User will receive a box containing scented candles of all lines and formats. The number of candles in the box will be chosen at your discretion, following seasonality and trying to vary the assortment of style and fragrances as much as possible.

5.2. Shipping is free and the User will receive the box containing the candles every 3 months at the address indicated during subscription activation.

Shipments will be made in the following months: January, April, July, October and will be processed on the 16th-17th-18th-19th of these months.

Subscriptions signed after the 15th day of the shipping months will be processed in the following 3 months (Example 1: if the subscription is signed up on 16 April, the first box will be processed in the month of July; Example 2: if subscription registration takes place on 15 July, the first box will be processed in July).

5.3. It will be possible to subscribe at any time. The amount of the subscription will be charged to the payment method indicated when signing up for the subscription. This amount will be charged every 3 months on the same day as the subscription, except for external problems related to the payment circuit.

By subscribing to the subscription service, you authorize the Owner to automatically charge the cost of the current subscription using the payment method selected during subscription. In the event that it is not possible to charge the registration costs for the subscription service because the payment method becomes invalid or because the charge is denied for any other reason beyond the control of the Owner, the User must indicate within 2 days a valid payment method, otherwise the registration will be cancelled.

5.4. The subscription can be canceled at any time, free of charge and without penalties, by sending a communication to lunariacandles@gmail.com or directly on the website www.lunariacandles.it by accessing the personal section (only for registered users).

6. Billing

6.1. The commercial invoice, if requested by the User, will be sent by the Owner based on the data provided during the purchase of the order. For the issuing of the invoice, the information provided by the User will be considered as valid, which he declares and guarantees to be truthful, granting the Owner all the most extensive indemnity in this regard.

7. Shipments

7.1. The Owner will arrange for the shipment of the Products purchased on the Site, selected and ordered in the manner provided for in the previous articles, within a maximum period of 7 working days.

7.2. The Owner will deliver to the User, at the address indicated by them, the Products selected and ordered, in the manner provided for in the previous articles, via trusted courier and/or shippers.

7.3. The Owner assumes no responsibility for the delay or failure to deliver the goods attributable to causes of force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, to execute the contract within the agreed times. The Owner will not be liable to any party or third party for damages, losses and costs suffered as a result of failure to execute the contract for the causes mentioned above.

8. Right of withdrawal

8.1. The User who holds the status of consumer (see art. 3, paragraph 1, letter a) of Legislative Decree 206/2005 - Consumer Code) who for any reason is not satisfied with the purchase made has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason within 14 days from the date of delivery of the Product. In order to withdraw from the contract, the User must contact the Owner at the email address lunariacandles@gmail.com. The User will be informed of the procedures for returning the Product.

8.2. The User must return the Products purchased using a carrier of their choice and at their own expense, without undue delay and in any case within 14 days from the date on which they communicated their decision to withdraw to the Owner.

8.3. The User is responsible for the integrity of the Product as long as the same good is in his possession and must take all appropriate measures to preserve the Product and do everything possible to ensure that the Product is returned in the best possible condition, including original packaging that has not been damaged or tampered with, the instruction sheet, accessories, any separate items and any other components.

8.4. The Owner will not consider return requests in the event that the Product is malfunctioning due to improper use, negligence, physical, aesthetic or superficial damage or alterations, tampering or improper maintenance or wear and tear.

8.5. Only after ascertaining the integrity of the returned Product will the Owner refund the User the entire amount initially paid, within 14 days from the date of receipt of the returned Product. The Owner will reimburse the User using the same payment methods used by the User for the online purchase.

8.6. The right of withdrawal is excluded in relation to the supply of Products made to measure or clearly personalized upon request of the User.

9. Compliance with warnings and precautions for use

9.1. The Owner is not responsible for any damage to people and/or things caused by failure to comply with the warnings and precautions for use.

9.2. The same warnings and precautions for use are intended as relating to any product present on the Site and clearly described and explained on the Site itself.

9.3. These warnings and precautions for use are automatically considered read and accepted by the User when the User has completed and finalized an order on the Site.

10. Industrial and Intellectual Property Rights

10.1. The Owner declares to be the owner and/or licensee of all intellectual property rights relating to and/or relating to the Site and/or the materials and contents available on the Site.

10.2. The User may access the Site but no license to use the contents and/or materials available on the Site is granted to any User.

Any use and/or reproduction of the materials or contents present on the Site is strictly prohibited.

10.3. All trademarks, figurative or nominative and all other signs, trade names, service marks, word marks, commercial names, illustrations, images, logos appearing on the Site are and remain the exclusive property of the Owner or its licensors and are protected by current trademark laws and related international treaties.

10.4. Any reproductions in any form of the explanatory texts and contents of the Site, if not authorized, will be considered violations of the intellectual and industrial property rights of the Owner.

11. Privacy

11.1 The provisions regarding the protection and processing of personal data are contained on the Site, in the “Privacy Policy” section.

12. Applicable law and competent court

12.1. These Conditions and all disputes regarding the execution, interpretation and validity of this contract are subject to Italian law and the exclusive jurisdiction of the court of the place where the Owner is based.

13. Online Dispute Resolution for Consumers

13.1. The Consumer resident in Europe must be aware of the fact that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by the Consumer to resolve non-judicial disputes relating to and/or deriving from contracts for the sale of goods and services stipulated online. Consequently, the Consumer can use this platform to resolve any dispute arising from the online contract stipulated with the Owner.
